I don't believe that a doctor is forced to lie so that he will be able to have a chance at bettering himself in the future. Patients understand that the doctor can only do what he can. Especially if the doctor explains the consequences of his mistake. Honesty is the best policy. It is the best way to correct any mistake. And to make someone a better doctor.
If someone is harmed by a doctor, then they should get damages. WITHOUT having to go to court. It makes absolute sense that this should happen. Why would a judge have to decide if harm occurred? A judge isn't a doctor. When things go wrong, it is as plain as the nose on a face WHY it happened. The people looking at the matter are doctors...
